New qualification has been added to the Integrated Qualifications System that can potentially relieve the courts by bringing about a settlement between the injured person and the person who committed a crime or misdemeanour. The qualification "Conducting mediation in criminal and misdemeanour cases" was included by the Minister of Justice.
Conducting mediation in criminal and misdemeanour cases
The holder of the qualification "Conducting mediation in criminal and misdemeanour cases" is ready to independently plan and conduct criminal and misdemeanour mediation both in out-of-court proceedings, in court, as well as with convicted and post-conviction persons. Based on an analysis of the case, he/she assesses whether there are any contraindications to mediation. The activities undertaken by the holder are directed at helping the parties to formulate the content of the settlement between the victim and the person who committed a crime or misdemeanour. Uses knowledge of the conduct of mediation proceedings with particular emphasis on the legal framework of mediation in criminal and misdemeanour cases. In his/her work, he/she cooperates with the authority managing the case. In the mediation conducted, he/she applies knowledge of the issues of aggression and violence and their psychological determinants. Works in accordance with the methodology of mediation and the rules of professional ethics of a mediator, uses communication tools and techniques, taking into account the sense of security and stability of the parties. Uses emotion management techniques. Uses the basic conceptual structure of criminal law. Constantly updates his/her knowledge of mediation and the application of the legal basis related to the mediation procedure. When preparing and conducting a mediation meeting, he/she takes into account the distinctive nature of a particular case and the variety of possible determinants of the problem. Improves his/her professional competence in relation to the professional experience already gained, confirmed by documents, and based on self-assessment. The holder of the qualification is aware of the significant social responsibility that comes with mediation.
